Flere av de fremsatte p\u00e5stander fremst\u00e5r \u2013 s\u00e5 langt \u2013 mer som antagelser enn som beviste fakta. P\u00e5 et slikt grunnlag kan jeg ikke slutte meg til mistilliten. Jeg m\u00e5 ogs\u00e5 minne s\u00e5 vel meg selv som alle andre om f\u00f8lgende bestemmelse i Kirkens lovgivning: <em>Ingen har lov til rettsstridig \u00e5 skade det gode renomm\u00e9 som en nyter, heller ikke til \u00e5 krenke den personlige rett til verge av eget privatliv.<\/em> (CIC, kan. 220)<\/p>\n<p style=\"text-align: justify;\">Jeg er ogs\u00e5 kommet til at pastor Jos\u00e9 Johan Dumandan gj\u00f8r en innsats i menigheten som er til gagn for Evangeliets sak og for mange mennesker.<\/p>\n<p style=\"text-align: justify;\">Samtidig m\u00e5 jeg konstatere at mange i og omkring det filippinske milj\u00f8 ikke er enig i dette.<\/p>\n<p style=\"text-align: justify;\">Jeg er samtidig temmelig overbevist om at flere p\u00e5 alle kanter har valgt \u00e5 forholde seg til hverandre p\u00e5 en m\u00e5te som ikke alltid har v\u00e6rt optimal for \u00e5 bilegge uenighet og bygge et godt fellesskap. Jeg minner om at det \u00f8verste positive ansvar her ligger p\u00e5 den av biskopen utnevnte innvandrerprest.<\/p>\n<p style=\"text-align: justify;\">Min prim\u00e6re oppfordring og b\u00f8nn er derfor at dere alle begynner \u00e5 s\u00f8ke konstruktiv kontakt. Det forutsetter at man alltid gj\u00f8r sitt beste \u00e5 forst\u00e5 hvordan andre tenker f\u00f8r man fremsetter kritikk, og at man fors\u00f8ker \u00e5 ta alt i beste mening.<\/p>\n<p style=\"text-align: justify;\">Klarer man likevel ikke \u00e5 finne sammen p\u00e5 denne m\u00e5te, vil nok det beste v\u00e6re \u00e5 gj\u00f8re sin innsats i Kirken separat, i hvert fall en tid, jf. Abrahams ord til Lot: \u00abSkill heller lag med meg! Tar du til venstre, drar jeg til h\u00f8yre. Og tar du til h\u00f8yre, drar jeg til venstre.\u00bb (1 Mos 13,9) St. Paul menighet er mer <em>Sacred Heart Filipino Chaplaincy<\/em>, og dets lokale fellesskap. Det finnes messer og aktivitetsmuligheter innen Kirken som samtidig er utenfor det gamle organiserte filippinske fellesskap. I menigheten som helhet har man mulighet b\u00e5de til \u00e5 arbeide sammen med ulike personer med egen eller annen nasjonal bakgrunn, og s\u00e5gar til \u00e5 lage en ny filippinsk forening, uavhengig av <em>Sacred Heart Filipino Chaplaincy,<\/em> om det skulle v\u00e6re \u00f8nskelig. Selv om jeg ikke anbefaler det siste, er det i hvert fall en legitim mulighet.<\/p>\n<p style=\"text-align: justify;\">Som det skulle fremg\u00e5 av dette, vil jeg ikke ta initiativ til at pastor Jos\u00e9 Johan Dumandan blir omplassert fra menigheten i Bergen. Tvert imot stiller jeg meg bak ham i hans pastorale innsats. Denne konklusjon fra bisped\u00f8mmets side m\u00e5 andre ta til etterretning.<\/p>\n<p style=\"text-align: justify;\">Heri ligger ogs\u00e5 noe av forklaringen p\u00e5 hvorfor jeg velger \u00e5 konkludere som jeg gj\u00f8r i et eget dekret vedr\u00f8rende klagen p\u00e5 r\u00e5dsvalget.<\/p>\n<p style=\"text-align: justify;\">For ordens skyld minner jeg om at siden vi her ikke har \u00e5 gj\u00f8re med et \u00abforeningsstyre\u00bb (jf. kann. 309 og 324, \u00a7 1), men med et r\u00e5d (jf. kan. 536), dreier sammensetningen seg i mindre grad om hva som er \u00abrett\u00bb eller \u00abrettferdig\u00bb, men i st\u00f8rre grad om hva som er gagnlig.<\/p>\n<p style=\"text-align: justify;\">Men b\u00f8nn om Guds velsignelse for all virksomhet i St. Paul menighet, og med takk for alt filippinsk n\u00e6rv\u00e6r og innsats i dag b\u00e5de her og i resten av Norge.<\/p>\n<p>Bergen, 4. november 2014.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: left;\"><em>Msgr. dr. Dette r\u00e5d <em>(Council)<\/em> har visse medlemmer i embets medf\u00f8r, herunder innvandrerpresten, visse valgte medlemmer og visse medlemmer utpekt av innvandrerpresten. De valgte medlemmer er tre, velges for to \u00e5r og kan kun gjenvelges en gang, dvs. kun sitte som valgte medlemmer i r\u00e5det fire \u00e5r i sammenheng. Tiden fra forrige gang det ble holdt valgt er s\u00e5 lang slik at lovlige valgperioder for lengst er utl\u00f8pt.<\/p>\n<ol style=\"text-align: justify;\" start=\"8\">\n<li>november 2014 ble det anordnet nytt valg av medlemmer til r\u00e5det.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">Av meddelelse om valgresultat fremg\u00e5r det at 98 tellende og en ugyldig stemme ble avgitt. Valgt ble for to \u00e5r: <em>Benito Braza, Jr.<\/em> (Chairman), <em>Reuel Cataylo<\/em> (Vice-Chairman) og <em>Rosemarie Lauv\u00e5s<\/em> (Secretary).<\/p>\n<p style=\"text-align: justify;\">Det er kommet inn en rekke skriftlige protester mot valget, datert 11. og 12. november 2014. I m\u00f8tet som undertegnede sammen med sognepresten hold 3. desember 2014 med om lag 30 personer som protesterte mot valget, ble disse protester gjentatt og forsterket ved skrevne og ikke-skrevne innlegg. Flere argumenter er blitt anf\u00f8rt, f.eks. at valget var udemokratisk og kaotisk, at de gamle medlemmer alt m\u00e5tte ha frasagt seg sine verv og at hele r\u00e5det skulle v\u00e6rt utskiftet samtidig. Mest alvorlig er anklagen om at det p\u00e5 forh\u00e5nd var gitt helt utilstrekkelig informasjon om valget.<\/p>\n<p style=\"text-align: justify;\">I en omfattende redegj\u00f8relse fra valgkomiteen <em>(COMELEC)<\/em> 28. november 2014 blir de skriftlige protester tilbakevist, bl.a. under henvisning til at valget ble kunngjort under den filippinske messe i forkant.<\/p>\n<p style=\"text-align: justify;\">Sognepresten har uttrykt stor tillit ikke bare til de mange filippinere som har protestert mot valget, men ogs\u00e5 til de mange filippinere som er aktive i Kirken, men uten \u00e5 ha st\u00f8ttet protestene. I tillegg til at han sterkt beklager den oppst\u00e5tte strid, har han tro p\u00e5 at de nyvalgte medlemmer av r\u00e5det sammen med dets \u00f8vrige medlemmer vil kunne gj\u00f8re en innsats til gagn for den pastorale virksomhet i menigheten.<\/p>\n<p style=\"text-align: justify;\">Ettersom de fastsatte valgterminer for lengst var overskredet og ettersom r\u00e5det er helt og holdent er begrunnet i godt og konstruktivt samarbeid med den av biskopen utnevnte innvandrerprest for filippinere i Bergen, var det meget gode og legitime grunner for \u00e5 holde nyvalg. Samtidig kunne nok ogs\u00e5 gode grunner talt for \u00e5 bruke litt lenger tid p\u00e5 \u00e5 forberede valget og forh\u00e5ndsinformasjonen burde v\u00e6rt adskillig bedre. Samtidig er forutsetningen for at et valg skal omst\u00f8tes etter protest fra enkeltperson som er forbig\u00e5tt ved innkallingen til valg, at vedkommende faktisk har v\u00e6rt uvitende om valget, har v\u00e6rt frav\u00e6rende ved valget og har protestert innen tre dager (jf. CIC, kan. 166, \u00a7 2). Disse krav er ganske sikkert ikke oppfylt for alle de protesterendes vedkommende, men kanskje for noen.<\/p>\n<p style=\"text-align: justify;\">Ut fra dette er jeg kommet til at det kan fremsettes relevante innvendinger mot gjennomf\u00f8ringen av valget. Samtidig ser jeg p\u00e5 r\u00e5det som mer funksjonsdyktig etter valget enn f\u00f8r valget, ogs\u00e5 tatt i betraktning det helt n\u00f8dvendige samarbeid med den av biskopen utnevnte innvandrerprest.<\/p>\n<p style=\"text-align: justify;\">For \u00e5 l\u00f8se den oppst\u00e5tte konflikt omkring valget, med henblikk p\u00e5 veien videre og ut fra s\u00e6rskilt mandat fra biskopen<\/p>\n<p style=\"text-align: center;\"><strong>dekreterer jeg:<\/strong><\/p>\n<ol>\n<li>De tidligere medlemmer av r\u00e5det <em>Pastoral Council of Our Lady of Fatima Bergen<\/em> l\u00f8ses fra deres verv.<\/li>\n<\/ol>\n<ol start=\"2\">\n<li>Valget 8. november 2014 av nye medlemmer av r\u00e5det saneres og blir derved gjeldende, ogs\u00e5 om det skulle v\u00e6re beg\u00e5tt avgj\u00f8rende feil i selve valgopplegget og -gjennomf\u00f8ringen.<\/li>\n<\/ol>\n<ol start=\"3\">\n<li>N\u00e5v\u00e6rende valgperiode avkortes til \u00e5 gjelde ut januar 2016.<\/li>\n<\/ol>\n<ol start=\"4\">\n<li>R\u00e5det p\u00e5legges f\u00f8r neste valg \u00e5 kunngj\u00f8re dette ved gudstjenester, oppslag, menighetens kunngj\u00f8ringer og p\u00e5 andre m\u00e5ter minst en m\u00e5ned i forveien.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>Bergen, 4. november 2014.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: left;\"><em>Msgr. dr. About 30 of you were present and you expressed a lack of confidence in Pastor Jos\u00e9 Johan Dumandan and criticism of the election on 8<sup>th<\/sup> Nov. of 3 new members of the Pastoral Council of Our Lady of Fatima, Bergen.<\/p>\n<p>I am also grateful for the opportunity to discuss the situation both with Pastor Jos\u00e9 Johan Dumandan and with the Parish Priest, Dom Alois Arnstein Brodersen, Can.Reg<\/p>\n<p>My conclusion is that we are of one mind about 3 issues: &#8211; we want what is best for both the Gospel and the Church in the Bergen area, &#8211; we are deeply upset by the conflicts that have arisen, &#8211; and we greatly appreciate the presence and the activity of the Philippino community here in Norway.<\/p>\n<p>On the basis of all that has come to light, I have come to the conclusion that I cannot support the deep seated lack of confidence in Pastor Jos\u00e9 Johan Dumandan, that many expressed. Several of the claims that have been made up to this point, consist of assumptions rather that of proven facts. I cannot support a statement of no confidence on such a basis. I have to remind everyone, myself included, of the law of the Church. CIC canon 220<\/p>\n<p>I am convinced that Pastor Jos\u00e9 Johan Dumandan serves the parish well, in a way that benefits the Gospel and many of the faithful. At the same time I am aware that there are many in or close to the Philippino community who do not agree with me in this.<\/p>\n<p>I am also fairly convinced that many on all sides have chosen an attitude to others that often has not been the best way to put an end to division and build a good community. I must remind everyone that the ultimate responsibility lies with the immigrant priest that the bishop has appointed.<\/p>\n<p>My main message and prayer is that everyone should start to find a way for constructive contact with those who see things differently. This of course involves trying to understand how the others think before criticizing them, &#8211; and to take everything they say as well-intended.<\/p>\n<p>If this sort of cooperation proves impossible, then it may be best to contribute to the life of the Church separately, &#8211; at least for the time being. Remember Abraham\u2019s words to Lot in Genesis ch.13,v.9: \u201cPart company with me, if you take the left, I will go right; if you take the right, I will go left.\u201d St Paul parish is more than the Sacred Heart Philippino Chaplaincy and those associated with it. There are several Masses and activities in the Church, apart from the organised Philippino community. In the parish as a whole one can work with others, both of one\u2019s own and other nationalities. There is also the possibility of forming a new Philippino group independent of the chaplaincy, if that proves to be preferable.<\/p>\n<p>As the above lines indicate, I do not recommend that Pastor Jos\u00e9 Johan Dumandan be moved from the parish in Bergen. On the contrary, I support him in his pastoral ministry. This is the conclusion of the diocese, which others just have to accept. I follow the same line of reasoning in a separate decree in answer to the protest about the election of members to the pastoral council.<\/p>\n<p>I feel obliged to point out, for the sake of clarity, that since this is not a case of an \u201cassociation\u201d (see CIC canon 309 and 324\u00a71) but rather\u00a0 a \u201ccouncil\u201d (see CIC canon 536), the whole question of the composition of the council has less to do with \u201claw\u201d and \u201cjustice\u201d, and more to do with what serves the purpose of the council best.<\/p>\n<p>I pray for God\u2019s blessing on all activity in St Paul\u2019s parish and am grateful for all Philippino presence and activity both here and elsewhere in Norway.<\/p>\n<p>&nbsp;<\/p>\n<p>Bergen, 4<sup>th<\/sup> December 2014<\/p>\n<p>&nbsp;<\/p>\n<p>Msgr. Dr. Torbj\u00f8rn Olsen,<\/p>\n<p>Episcopal Vicar.<\/p>\n<p>&nbsp;<\/p>\n<h1 style=\"text-align: center;\">THE CATHOLIC DIOCESE OF OSLO<\/h1>\n<p><strong>\u00a0<\/strong><\/p>\n<h2 style=\"text-align: center;\"><strong>DECREE<\/strong><\/h2>\n<p><strong>\u00a0<\/strong><\/p>\n<p>The Pastoral Council of Our Lady of Fatima, Bergen is a consultative council, equivalent to parish councils in the diocese (see the council\u2019s own Guidelines). However, it is linked to the Sacred Heart Chaplaincy for activity in St Paul\u2019s parish, Bergen and to the immigrant priest (chaplain) that the bishop has appointed to the parish for Philippino pastoral care.<\/p>\n<p>The council consists of some who are members because of the office they hold, among them the immigrant priest, some elected members and some who are nominated by the immigrant priest. There are 3 elected members who are elected for a 2 year term and can be re-elected just once, in other words can serve a maximum of 4 years at a time. A new election was overdue, as the previous election had been held so long ago that the council\u2019s mandate had expired.<\/p>\n<p>A new election of members to the council took place on 8<sup>th<\/sup> Nov. 2014. The election results show that 98 valid votes and one invalid vote had been cast. The following were elected for 2 years: <em>Benito\u00a0 Braza, Jnr <\/em>\u00a0(Chairman), <em>\u00a0Reuel Cataylo <\/em>(Vice-Chairman) and <em>Rosemarie Lauv\u00e5s <\/em>(Secretary).<\/p>\n<p>There have been many written protests against the election, dated 11<sup>th<\/sup> and 12<sup>th<\/sup> Nov.2014. These protests were repeated and strengthened both in writing and orally during a meeting that the undersigned and the Parish Priest held with some 30 protesters on 3<sup>rd<\/sup> Dec. 2014.<\/p>\n<p>Several reasons were presented, f.ex. &#8211; \u00a0that the election had been undemocratic and chaotic,\u00a0 that the former members should have resigned first and that the whole council should have been replaced on the same date. The most serious criticism was however that there had been inadequate information about the election beforehand.<\/p>\n<p>The election committee (COMELEC) answered the criticisms in detail in a report on 28th Nov. 2014 , also pointing out that that the election had been announced in advance during the Philippino Mass.<\/p>\n<p>The Parish Priest has expressed his confidence not only in the many Philippinos who protested but also in the many who are active in the Church but had not supported the protests. While being very upset by the conflict that has arisen, he believes that the newly elected members\u00a0 and the rest of the council will be able to make a positive contribution to the life of the parish.<\/p>\n<p>As the mandate of the previous council had long since expired and as the council in every way has had a good and constructive cooperation with the immigrant priest appointed by the bishop for the Philippino community in Bergen, there were good and legitimate grounds to hold a new election. At the same time one could have taken more time to prepare the election and there should have been far better information beforehand. However the conditions for declaring an election invalid, (because some were not invited to vote or were unaware of the election being held but protested within 3 days) were not fulfilled in the case of most protesters, though not all.<\/p>\n<p>Consequently I have concluded that there were valid criticisms of the way in which the election took place. Nonetheless I see that the council is now more competent that before the election, also when we consider the absolutely necessary cooperation with the immigrant priest whom the bishop has appointed.<\/p>\n<p>In order to contribute to a future solution of the conflict that has arisen and as part of the task entrusted to me by the bishop,<\/p>\n<p>&nbsp;<\/p>\n<p><strong>I hereby decree<\/strong><\/p>\n<ol>\n<li>The former members of the council \u201cThe Pastoral Council of Our Lady of Fatima, Bergen\u201d<\/li>\n<\/ol>\n<p>have no longer any responsibilities in this connection.<\/p>\n<ol start=\"2\">\n<li>The election of new members of the council on 8<sup>th<\/sup> Nov. 2014 is confirmed and valid, even if there were certain faults in the way the election was held.<\/li>\n<\/ol>\n<ol start=\"3\">\n<li>The mandate of the new council is to be shortened to the end of January 2016.<\/li>\n<\/ol>\n<ol start=\"4\">\n<li>The council will be obliged to announce the next election during Masses, on posters, in the parish newsletter and other ways at least one month in advance.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>Bergen, 4<sup>th<\/sup> Dec. 2014<\/p>\n<p>Msgr.
